1. Acceptance of Terms

By accessing or using Brevant ("the Service"), operated at brevant.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Brevant.

2. Description of Service

Brevant is an AI-powered business advisory platform designed for small business owners. The Service provides:

• Conversational AI assistance with persistent business memory
• Proactive insights and trend analysis
• Decision simulation and scenario planning
• Industry benchmarking and competitive analysis
• Goal tracking and accountability check-ins
• Document analysis and strategy generation

The Service is intended as a supplementary business tool and does not constitute professional financial, legal, tax, or accounting advice.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information during registration
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorised access to your account
• Not share your account with others or create multiple accounts

You must be at least 18 years old and have the legal authority to enter into these Terms to create an account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload malicious content, malware, or attempt to compromise the platform's security
• Reverse-engineer, decompile, or attempt to extract the underlying AI models or algorithms
• Use automated tools (bots, scrapers) to access the Service beyond the provided interface
• Resell, sublicense, or redistribute the Service or its outputs without authorisation
• Submit content that is illegal, fraudulent, defamatory, or infringes on intellectual property rights
• Attempt to circumvent usage limits, rate limits, or access controls

5. AI Disclaimer

Brevant provides AI-generated insights and recommendations. These are not a substitute for professional advice.

• AI-generated outputs may contain inaccuracies, outdated information, or errors. You should independently verify any advice before acting on it.
• Brevant is not a licensed financial advisor, attorney, accountant, or any other regulated professional. The Service does not provide financial, legal, tax, or investment advice.
• Decisions made based on AI recommendations are entirely your responsibility. Brevant shall not be liable for any business decisions made in reliance on the Service's outputs.
• Benchmarking data and industry comparisons are estimates based on available data and should not be treated as authoritative market research.
• Scenario simulations and decision analyses are hypothetical models, not predictions of actual outcomes.

6. Payment Terms

Subscription Plans

Brevant offers subscription-based pricing with monthly billing. Current plans and pricing are displayed on our website and may be updated from time to time.

Introductory Pricing

New subscribers may be eligible for a discounted introductory rate for their first month. After the introductory period, your subscription will automatically renew at the standard plan rate. You may cancel anytime before renewal.

Billing

• Subscriptions are billed monthly in advance on the anniversary of your subscription start date.
• All payments are processed securely by Stripe. We do not store your credit card information.
• Prices are listed in USD and exclude applicable taxes.

Cancellation

• You may cancel your subscription at any time from the Settings page.
• Cancellation takes effect at the end of your current billing period. You retain access to the Service until then.
• No refunds are provided for partial billing periods or unused time.

Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the start of the next billing period.

7. Intellectual Property

The Brevant platform, including its design, code, AI models, branding, and documentation, is the intellectual property of Brevant and is protected by applicable intellectual property laws.

You retain ownership of all content and data you submit to the Service (see Section 8). The AI-generated outputs (insights, recommendations, analyses) are provided for your use within the scope of your subscription.

8. Data Ownership

You own your data. All business information, documents, conversations, and other content you submit to Brevant remains your property. We do not claim ownership of your data.

You grant us a limited licence to process your data solely for the purpose of providing the Service, including AI analysis, insight generation, and persistent memory features. This licence terminates when you delete your account.

We do not sell, rent, or share your business data with third parties for their marketing or commercial purposes. Data sharing with third-party services is limited to what is necessary to operate the Service, as described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Brevant and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Any loss of profits, revenue, data, business opportunities, or goodwill
• Any damages resulting from business decisions made based on AI-generated advice or recommendations
• Any interruption, delay, or inability to access the Service
• Any inaccuracies in AI-generated content, benchmarks, or analyses

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to Brevant in the twelve (12) months preceding the claim.

10. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Third-party service outages (AI providers, hosting, database)
• Unforeseen technical issues or force majeure events

We do not offer Service Level Agreements (SLAs) or uptime guarantees. We will make reasonable efforts to notify users of planned maintenance in advance.

11. Termination

You may terminate your account at any time by deleting it from the Settings page or by contacting us at hello@brevant.ai.

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse the Service or its AI capabilities
• Fail to pay subscription fees when due

Upon termination, your access to the Service will cease and your data will be handled in accordance with our Privacy Policy data retention provisions.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the platform at least 30 days before they take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service and cancel your subscription.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Brevant is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation, and if unsuccessful, through binding arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
